Arzinger & Partners provides overall legal support in managing deals and carrying out projects in the sphere of real estate and construction.

When guiding the process of contract conclusion we provide precise analysis of the facility’s construction background, assist our clients in selecting the optimal type and form of designing the contractual relationship, we structure the deal itself, evaluate and refine the taxation matters connected, prepare a detailed legal opinion, hold negotiations with other business entities and the state officials, we develop and maintain the deal’s conclusion and fully support the process of fulfilling the contractual commitments undertaken by the parties.

Arzinger & Partners has gained significant experience in supporting construction activity in Belarus. We develop construction connected contracts (contracts on joint activity, share construction, investment agreements), advise on construction activity within Belarus, including the evaluation of legal risks and taxation matters, assist in receiving the construction license.

PROJECTS

In 2007-2008 Arzinger & Partners provided the development and conclusion of one of the top investment deals – the Investment Agreement with the Republic of Belarus on Developing the Territory of the High Technologies Park. The Investment Agreements provides for 550 mln EUR investing in the development of a multifunctional complex pf buildings within a 540 thousand square meters area. At present the implementation of this project is provided by a leading investment company from Israel – Fishman Group. Within the Investment Agreement Arzinger & Partners prepared contracts with design organizations, consultancy and construction firms.

Arzinger & Partners is proud of its services provided for the Swedish Bahco including preparing the building contract and the connected documentation. According to the National Investment Agency, Bahco Bisov is one of the most successful investment projects ever carried out in Belarus.

Arzinger & Partners advised two major players within the global construction market – the Belgian Besix and Turkish Őzaltin on matters of construction activity, taxation, licensing, attracting foreign workers and designing contractual relations. We represented Őzaltin when agreeing the conditions of developing residential premises in Minsk with state design organization Minskstroy. At present Őzaltin actively participates in residential development in Minsk.

Arzinger & Partners contributed to the privatization process that activated in Belarus in 2008. One of latest projects in this area – privatization of the state-owned clothes factory Motex and its transformation into a open joint stock company with the participation of a major Russian investor – JSC Tutaev Clothes Factory.
